A proposed class action out of Florida claims defendant Escallate, LLC routinely violates the Telephone Consumer Protection Act and Fair Debt Collection Practices Act.
A proposed class action out of Florida claims defendant Escallate, LLC routinely violates the Telephone Consumer Protection Act (TCPA) and Fair Debt Collection Practices Act (FDCPA) by using a prohibited automatic dialing system to place non-emergency calls to consumers’ cell phones without permission to collect debts. The lawsuit notes the plaintiff mailed a letter to the defendant ordering the company to cease and desist any communication with her, to which it responded that it was “not able to locate an account in our system” that matched the plaintiff. The complaint goes on to note the plaintiff allegedly continued to receive calls to her cell phone from the defendant through the end of 2016 into 2017.
