A California woman has named Moore Brewer Wolfe Jones Tyler & North, along with Cabrillo Credit Union, as defendants in a proposed class action lawsuit.

A California woman has named Moore Brewer Wolfe Jones Tyler & North, along with Cabrillo Credit Union, as defendants in a proposed class action lawsuit that alleges they violated the Fair Debt Collection Practices Act and California state law. The plaintiff claims she received a letter from the defendants that indicated she owed a certain amount of money “plus accruing interest, attorney fees and other charges,” but that the defendants were not authorized to collect these extra fees. The suit further claims that the defendants failed to comply with the FDCPA’s requirement that debt collectors send consumers a notice of their rights, including their right to dispute their alleged debts, within five days of initial communication.
The suit seeks to cover “[a]ll persons within California who received any collection correspondence from Defendants, within the one year prior to the filing of this Complaint, that is identical or substantially similar to the June 14, 2016 correspondence Plaintiff received from Defendant.”
