A proposed class action has been filed against defendant Portfolio Recovery Associates, LLC, citing violations of the FDCPA, the Texas Debt Collection Act, and the TCPA.
A proposed class action has been filed against defendant Portfolio Recovery Associates, LLC, citing violations of the Fair Debt Collection Practices Act, the Texas Debt Collection Act, and the Telephone Consumer Protection Act. The complaint says the defendant called the plaintiff on his cell phone four times from an automated dialing system with the aim of collecting an alleged debt. The plaintiff claims he then requested in writing that the defendant stop calling him and asked for verification of the debt. Allegedly, Portfolio Recovery made 15 additional calls to the plaintiff and did not send verification for the debt in question. According to the complaint, the plaintiff “is – and remains to this day – uncertain as to what debt, if any, Defendant is calling about.”
