Debt Collector National Recovery Agency ‘Bombards’ Consumers with Unwanted Texts, Class Action Says

The 13-page lawsuit says that NRA Group, which does business as National Recovery Agency, has run afoul of the Fair Debt Collection Practices Act (FDCPA) by “bombard[ing] consumers” with debt collection text messages, even after the individuals have replied “STOP” to cut off contact.
The plaintiffs, residents of Indiana, Maryland and Massachusetts, each began to receive debt collection text messages to their cell phones from the company within the last year, the suit relays. The near-identical texts provided details about each plaintiff’s alleged debt, such as the original creditor and the balance owed, as well as contact information for National Recovery Agency and payment instructions, the case shares.
As the complaint tells it, the text messages advised the plaintiffs that “[to] stop receiving text messages reply STOP.” Despite numerous requests from each plaintiff to “STOP” the messages, the company disregarded the replies and continued to send texts to their cell phone numbers, the filing alleges.
“This is not the first time [National Recovery Agency] has been sued for its illegal text messaging practice,” the suit reads. “Yet despite being put on notice of its illegal conduct, [the defendant] still ignores consumer’s [sic] requests to ‘STOP’ communicating with them, in violation of the FDCPA.”
The “annoyed” and “frustrated” plaintiffs feel their time has been wasted dealing with the company’s texts after the consumers have explicitly requested an end to the communications, the case says.
The lawsuit looks to represent anyone in the United States who has received a debt collection text message to their cell phone from National Recovery Agency since March 22, 2022 after previously replying “STOP” (in any combination of upper or lowercase letters) or requesting that the messages stop in an identifiable way.
