A New York man filed a proposed class action against Kozeny, McCubbin & Katz LLP claiming the debt collector violated the Fair Debt Collection Practices Act (FDCPA).

A New York man filed a proposed class action against Kozeny, McCubbin & Katz LLP claiming the debt collector violated the Fair Debt Collection Practices Act (FDCPA). The defendant allegedly sent the plaintiff a letter regarding an alleged debt, but unlawfully failed to inform him of his options to dispute the debt, obtain verification of the debt, or request his creditor’s information. According to the complaint, the debt collector also indicated that certain fees could be added to the balance listed in the letter, but did not specify what the fees were or how they would be calculated. Therefore, the suit argues, the defendant failed to clearly communicate the amount of the alleged debt as required by the FDCPA, and the least sophisticated consumer would not be able to determine how much he or she actually owed or how to dispute it.
