Another day, another proposed class action filed against debt collector GC Services Limited Partnership.
A Wisconsin woman’s proposed class action against GC Services Limited Partnership alleges the debt collector sent her a notice that was not compliant with the Fair Debt Collection Practices Act (FDCPA). According to the lawsuit, the collection notice in question was wholly “confusing and misleading” because, while it purported to be “here to work with [her] to find a mutually agreeable solution” for her debt, the letter also included the following:
New Balance: $972.44
Minimum Payment Due: $972.44
The case argues the above information, viewed through the “unsophisticated consumer” lens, is confusing because “there cannot be other opportunities available if the minimum payment is in the amount of the entire balance.” Adding to this, the lawsuit alleges the defendant’s mention in the notice of “interest, late charges, and other charges that may vary from day to day” makes it unclear whether the minimum payment was, at some other time, a different amount.
