Fairfax Servicing, LLC is facing a New York man’s claims that the company violated the Fair Debt Collection Practices Act by failing to clearly identify itself in messages it left on his answering machine.

Fairfax Servicing, LLC is facing a New York man’s claims that the company violated the Fair Debt Collection Practices Act (FDCPA) by failing to clearly identify itself in messages it left on his answering machine. According to the complaint, Fairfax Servicing called the plaintiff several times and left messages urging him to call back regarding “important and confidential information.” The suit argues that the communications were either pre-recorded or pre-scripted and failed to identify Fairfax as a debt collector attempting to collect a debt, an alleged violation of the FDCPA.
