A Florida woman has filed suit against Receivables Performance Management, LLC, claiming the debt collector incorrectly identified her creditor in a collection letter.

A Florida woman has filed suit against Receivables Performance Management, LLC, claiming the debt collector incorrectly identified her creditor in a collection letter. The letter supposedly named “Kohl’s Department Stores, Inc” as both the creditor and the original creditor to whom the plaintiff’s alleged debt was owed. She argues that the actual creditor is Capital One Bank, N.A., which was allegedly not mentioned at all in the letter. According to the suit, Receivables Performance Management violated the Fair Debt Collection Practices Act by failing to clearly identify the consumer’s creditor as required.
