Zwicker & Associates, P.C. is facing a proposed class action filed by a New York man who alleges the debt collector misrepresented the amount of his purported obligation.
Zwicker & Associates, P.C. is facing a proposed class action filed by a New York man who alleges the debt collector misrepresented the amount of his purported obligation. According to the complaint, the defendant sent the plaintiff two collection letters stating that he owed a specified amount “as of the date” of the letter. The suit claims the language in the letters falsely implied that the plaintiff’s balance was continuously increasing due to interest or other added fees and that the amount he would be required to pay in the future would be higher.
The case argues that the plaintiff’s account was not, in fact, subject to interest or other charges and that the statement in the letters “only serves to confuse” the man and intimidate him into paying off his balance sooner.
