R.T.R. Financial Services Inc. is on the receiving end of a proposed class action lawsuit that claims it sent a New York man a collection letter that failed to comply with the Fair Debt Collection Practices Act. According to the suit, the letter violated the FDCPA in the following ways:
- It failed to clearly communicate the amount of time the plaintiff had to dispute the alleged debt by indicating the validation period began after he received the “INITIAL NOTICE” without specifying whether that specific letter was the initial notice.
- It implied that the plaintiff must submit any disputes in writing and could not submit an oral dispute.
- It failed to “clearly differentiate” between disputing a debt and requesting verification.
