Daniels v. Receivable Collection Services, Llc
Filed: December 11, 2017 ◆§ 2:17cv7206
Receivable Collection Services, LLC is on the receiving end of a proposed class action lawsuit filed by a New York woman who claims she was deceived by the defendant’s collection letter.
New York
Receivable Collection Services, LLC is on the receiving end of a proposed class action lawsuit filed by a New York woman who claims she was deceived by the defendant’s collection letter. The letter allegedly contained the following statement:
“Should we not hear from you and/or your account remains unpaid, collection activities will continue.”
The suit argues that this language was meant to discourage the plaintiff from exercising her validation rights because it allegedly implies that collection activities may continue during the verification process.
The plaintiff also claims the letter neglected to specify whether her balance would increase due to interest, late fees, and other charges in violation of federal debt collection law.
