Davis v. Continental Service Group, Inc. et al
Filed: March 20, 2018 ◆§ 8:18cv676
Continental Service Group has been accused of violating the Fair Debt Collection Practices Act.
Florida
Continental Service Group, Inc. has been hit with a proposed class action alleging the debt collector falsely threatened a consumer with added interest and fees despite knowing the woman's balance would remain static. According to the suit, the defendant sent the plaintiff a collection letter regarding a debt allegedly owed to Hillsborough Community College that contained the following statement:
“Because the debt may require you to pay interest on the outstanding portion of your balance, as well as other assessed charges, which may vary from day to day, the amount required to pay this debt in full may be greater than the amount stated here.”
The suit claims Continental was aware that the plaintiff’s creditor would not demand additional interest or fees, yet falsely threatened her with the possibility of a balance increase in order to coerce the woman into paying the debt as soon as possible. The letter, according to the complaint, was “merely a deceptive collection tactic” meant to discourage the plaintiff from daring to dispute the debt or requesting validation at the risk of accruing additional fees.
