Client Services, Inc. is on the receiving end of a proposed class action lawsuit filed by a man who claims the defendant sent him a misleading debt collection letter. The letter allegedly contained the following statements:
“As of the date of this letter, the balance due is $2,599.45. On the date you make a payment, the balance due may be greater because of interest or other charges. If an adjustment is necessary after we receive payment, we will attempt to contact you.”
The complaint claims the defendant misled the plaintiff by implying that his account balance may change but failing to inform him of the interest rate, the date of accrual, any added fees that might apply, and other information that would allow him to calculate “the actual amount” due.
