Debt Collection Complaint Brought in NY against Arstrat

Silber, Individually And on Behalf of All Others Similarly Situated v. Arstrat, Llc et al
Filed: December 29, 2017 ◆§ 1:17cv7569
According to a lawsuit, Arstrat mailed a consumer a collection notice in which it failed to clearly identify the man's current creditor.
Arstrat, LLC finds itself as the defendant in a proposed class action in which the plaintiff claims a notice mailed by the debt collector in December 2016 failed to explicitly identify his current creditor as required by law. According to the complaint, the defendant’s notice stated “Client Name: Long Island Jewish Medical Center” without indicating whether this entity was in fact the creditor to whom the plaintiff’s debt was owed.
“Mere allusions to the creditor’s identity are insufficient. The letter must specifically and clearly identify the creditor of the collection amount,” the lawsuit asserts.
Moreover, despite stating that “the above creditor has referred the above account to us for collection . . . the creditor has now engaged ARSTAT to collect this account,” the defendant’s notice allegedly failed to identify any party as the creditor, nor did it indicate who referred the plaintiff’s account to Arstrat.
