Midland Credit Management, Inc., Midland Funding, LLC and Encore Capital Group, Inc. are the defendants in a class action claiming they violated the TCPA.
Midland Credit Management, Inc., Midland Funding, LLC and Encore Capital Group, Inc. are the defendants in a class action claiming the debt collection and acquisition groups violated the Telephone Consumer Protection Act (TCPA). The plaintiff alleges the companies placed calls to consumers’ cell phones using an automatic dialing system, called a predictive dialer, with a prerecorded voice message without first receiving express written consent.
The proposed class encompasses anyone in the United States who did not provide their phone number yet received a call to his or her cell phone made with an auto-dialing system from any of the defendants between September 1, 2014 and the present.
