Filed in New York, the suit claims the letter sent by the defendants to the plaintiff failed to explicitly and clearly identify the name of creditor to whom the debt is owed. According to case documents, “merely naming the creditor without specifically identifying the entity as the current creditor” is a violation of the FDCPA, as is conveying such information in a way that could be confusing to the unsophisticated consumer.
