A New York consumer claims she received a notice from Miller & Milone in which the firm failed to clearly identify the creditor to whom payment is owed.
A New York consumer has filed a proposed class action in which she claims defendant Miller & Milone, P.C. mailed her a collection notice that failed to properly identify the name of the creditor to whom the debt is owed. The complaint states the defendant’s letter listed “NEW YORK-PRESBYTERIAN/BROOKLYN METHODIST,” yet did not specifically identify the entity as either the original creditor, current creditor, or the creditor to whom the debt is owed. The notice, viewed through the lens of the Fair Debt Collection Practices Act (FDCPA), is deceptive and misleading, the lawsuit argues.
