A class action over alleged violations of the Fair Debt Collection Practices Act (FDCPA) has been filed against Kirschenbaum, Phillips & Levy, P.C. in New York. The lawsuit claims the defendant sent collection letters to proposed class members over debts owed to Barclays Bank Delaware. In these letters, the defendant allegedly misled the plaintiff into thinking a proposed debt settlement offer would only be valid if payment was received by a certain date. In truth, the settlement was not a “limited time offer” and purporting it as such, the lawsuit claims, is a violation of the FDCPA. These kinds of deceptive statements, the case argues, are tactics meant to impart the unsophisticated consumer with a false sense of urgency.
