Central Credit Services, LLC is facing a Wisconsin woman’s proposed class action lawsuit that accuses the debt collector of violating federal law in its communications with consumers. The plaintiff says she received a collection letter from the defendant that presented her with two payment options. The second option allegedly offered her a settlement without providing any date before which her payment needed to be received. Just below the options, however, the defendant noted that it was “not obligated to renew these offers,” the suit claims. The complaint argues that this language implied to the plaintiff that the settlement was a “limited time offer” but did not say when the offer would expire, subjecting her to the risk of sending a payment that would fail to settle her account.
On top of that, the letter also instructed the plaintiff to call the defendant with “any questions regarding [her] account,” the complaint notes. According to the suit, this statement would mislead the unsophisticated consumer into thinking he or she could dispute the alleged debt – and cause the debt collector to cease most collection activities – over the phone when federal law requires disputes to be submitted in writing.
