The 32-page KemperSports data breach lawsuit says the golf course and hospitality management company discovered suspicious activity on its computer network on April 1, 2024. According to the case, a subsequent investigation determined that an unauthorized third party had gained access to certain files stored in the defendant’s computer systems that same day.
As KemperSports’ data breach notice letter tells it, the incident impacted at least the names and Social Security numbers of primarily current and former employees.
The data breach suit claims the cyberattack stemmed directly from the company’s “grossly negligent—indeed, reckless—failure” to implement proper data security protocols to safeguard the stored information.
“None of this should have happened,” the complaint contends, alleging that KemperSports could have prevented the incident by complying with industry standards and maintaining reasonable cybersecurity practices.
Per the filing, the company should have anticipated the risk of being targeted by cybercriminals, given that data breaches have “dominated the headlines for the last two decades.”
“Due to [KemperSports’] negligence and failures, cyber criminals obtained and now possess everything they need to commit personal identity theft and wreak havoc on the financial and personal lives of thousands of individuals, for decades to come,” the class action suit charges.
What’s more, although the company purports to have detected the incident in early April 2024, it waited until this month to begin notifying victims, the complaint shares. The case argues that the “inexplicable delay” has only “further exacerbated” the lifelong consequences that affected individuals now face.
The KemperSports lawsuit looks to represent anyone in the United States whose personal information was compromised as a result of the data breach.
