A proposed class action has been filed against D&A Services, LLC of IL by a woman who claims the debt collector violated federal law by failing to specify whether her account balance was increasing.
A proposed class action has been filed against D&A Services, LLC of IL by a New York woman who claims the debt collector violated federal law by failing to specify whether her account balance was increasing. According to the complaint, the defendant sent the plaintiff a collection letter that listed her “current balance” without any further explanation of interest or other possible fees. The suit argues that the defendant’s language falsely implied that the plaintiff’s balance was increasing and that she would benefit by paying it off as soon as possible. Alternatively, the complaint alleges, if the plaintiff’s account were subject to added fees, the defendant failed to provide the information needed to calculate her true balance.
