A proposed class action out of New York federal court accuses D & A Services, LLC and JH Portfolio Debt Equities, LLC of sending an unlawful letter to a consumer.
The March 2018 letter referenced a debt owed to JH Portfolio, the case states. The consumer claims, however, that she did not owe any debt to the company nor contracted with it at any time.
The case takes further issue with the letter in that it allegedly failed to clearly convey the supposed debt amount by not disclosing that the balance may increase due to interest and fees.
“The Letter, because of the aforementioned failures, did not convey 'the amount of the debt' clearly from the perspective of the least sophisticated consumer,” the lawsuit reads.
