The operating company of apparel and accessories retailer Hustler Hollywood is the defendant in a proposed class action that claims the company unlawfully subjects its customers to the risk of identity theft by printing credit and debit card expiration dates on receipts. The plaintiff allegedly made a purchase at one of the defendant’s locations – and his credit card’s entire expiration date was visible on the receipt. The suit cites the Fair and Accurate Credit Transactions Act, an amendment of the Fair Credit Reporting Act, and argues that Hustler Hollywood is prohibited from printing on a customer’s receipt more than the last five digits of a card number or the card’s expiration date. The plaintiff claims the increased risk of identity theft posed by the defendant’s behavior caused him “aggravation and stress.” The suit further argues that the disclosure of his financial information was an invasion of privacy.
