‘Current Balance’ Doesn’t Tell the Whole Story, Lawsuit Against Debt Collector Claims
Last Updated on May 8, 2018
Polak v. Phillips & Cohen Associates, Ltd.
Filed: December 12, 2017 ◆§ 1:17cv7220
Phillips & Cohen Associates faces a lawsuit in which the plaintiff claims the 'Current Balance' stated in a collection notice is deceptive.
New York
Phillips & Cohen Associates, Ltd. is the defendant in a proposed class action in which the plaintiff claims the debt collector mailed him a collection notice that could reasonably be read to have two or more different meanings. The case alleges the defendant’s statement in the notice of the plaintiff’s supposed “Current Balance” is deceptive because claiming the man’s balance is “current” implies that it could be subject to interest and will therefore change in the future.
