A New York man has filed suit against C.Tech Collections, Inc. alleging the debt collector failed to clearly communicate his right to dispute the supposed debt or request validation.
A New York man has filed suit against C.Tech Collections, Inc. alleging the debt collector failed to clearly communicate his right to dispute the supposed debt or request validation. The suit claims the defendant sent the plaintiff a collection letter that referenced two different dates on which the notice was supposedly sent, leaving the plaintiff unsure as to when the 30-day period would expire during which he could dispute the alleged debt. The letter further instructed the plaintiff to “MAIL ALL CORRESPONDENCE & PAYMENTS TO” a physical address, the complaint alleges, implying that disputes must be submitted in writing rather than over the phone.
