Credit Solutions, LLC is the defendant in a proposed class action lawsuit filed in Kentucky alleging violations of the Fair Debt Collection Practices Act (FDCPA). The plaintiff in the case says he received a collection letter from the defendant that informed him of his account balance and his right to dispute the alleged debt. Missing from the letter, the complaint says, was the required instruction that disputes must be submitted in writing. According to the suit, the defendant’s nondisclosure could lead the least sophisticated consumer to falsely believe that he or she could dispute the debt over the phone, which the complaint says would not be sufficient to trigger FDCPA protections – namely, its requirement that debt collectors cease attempts to collect debts under dispute.
