A proposed class action alleging violations of the Telephone Consumer Protection Act (TCPA) has been filed against defendant Credit One Bank, N.A. A California woman filed the case against the bank after it allegedly sent her at least 16 text messages using automated dialing technology without obtaining her prior consent to receive them. The messages, according to the complaint, concerned a purported debt owed by the plaintiff and occurred after her attorney sent cease and desist letters to the defendant on her behalf. The plaintiff claims the texts violated her “legally protected interest in privacy” as specified under the TCPA.
