A consumer alleges Credit Management, L.P. mailed a collection notice that stated a 'current balance' that may be misleading.
Credit Management L.P. finds itself as the defendant in a proposed class action in which the plaintiff claims the company’s inclusion of a “Current Balance” in a collection notice was misleading. The lawsuit charges the defendant’s statement of a “Current Balance” violates federal debt collection laws because listing such without further clarification falsely suggests, the complaint reads, “that immediate payment of the balance would benefit [the plaintiff] by implying that the balance would be subject to change, and could be subject to additional interest.” Essentially, the case says, the notice may be read by the plaintiff as having one or more meanings concerning the actual balance due, with one of which being inaccurate.
