Neill et al v. Credit Corp Solutions, Inc. DBA Tasman Credit
Filed: April 13, 2017 ◆§ 1:17-cv-02689
Credit Corp Solutions, Inc., doing business as Tasman Credit, is the defendant in a proposed class action lawsuit that claims it failed to clearly identify creditors.
Credit Corp Solutions, Inc., doing business as Tasman Credit, is the defendant in a proposed class action lawsuit that claims it failed to clearly communicate in collection letters the identity of the consumers’ creditors and the amount of their alleged debts. From the complaint:
“Defendant gave contradictory information as to the creditor of the debt in its collection letters. In its letters, defendant stated that the creditor was Credit Corp Solutions, Inc. However, in its letters defendant also stated that Credit Corp Solutions, Inc. had assigned all rights, title and interest in the debt to Credit Corp Solutions, Inc. dba Tasman Credit.”
The suit argues that the unsophisticated consumer would be uncertain whether “Credit Corp Solutions, Inc.” and “Credit Corp Solutions, Inc. dba Tasman Credit” were two different entities, and if so, which would be the creditor.
The complaint further claims that the letter failed to indicate whether the plaintiff’s balance would increase due to interest or fees, leaving her uncertain as to how to proceed with paying off the alleged debt.
