Arizona
Credence Resource Management, LLC has been accused in a proposed class action of violating the Fair Debt Collection Practices Act (FDCPA) by charging an illegal “card fee” for electronic payments. The plaintiff claims the defendant deducted monthly payments from her checking account through her debit card and collected a $5 fee each time. The suit argues that these extra charges were not authorized by the plaintiff’s contract with her creditor and were not permitted by law, rendering them illegal under the FDCPA.
