Court Preliminarily Approves Centerspace Settlement, Resolving Data Breach Lawsuit

The class action settlement, which was granted preliminary approval by the court on July 29, 2024, covers any Unites States resident who received notice from Centerspace that their personal data was impacted by the cybersecurity incident experienced by the company in or around November 2021.
To receive Centerspace settlement benefits, eligible class members must submit a valid claim form online or by mail by November 26, 2024.

Class members will need their unique Claim Login ID and Claim Login PIN to file a Centerspace claim form online. This information can be found on the postcard settlement notice mailed to those covered by the deal.
According to the settlement website, eligible consumers may file a claim for two years of credit monitoring and identity theft protection services, benefits available to all class members regardless of whether they previously accepted Centerspace’s offer of complimentary services following the data breach.
In addition, class members may submit a claim for up to $525 per person for “ordinary” out-of-pocket expenses incurred after April 26, 2023 that are supported by documentation and reasonably linked to the incident, the site says.
Per the website, class members may also file a claim for reimbursement of up to four hours of lost time spent dealing with issues related to the Centerspace data breach, at a rate of $18.75 per hour, and limited to $75 per person.
Claims for ordinary losses and lost time are subject to a combined $525 cap per person, the site points out.
Moreover, class members who submit a timely, valid claim may also be eligible for reimbursement of documented “extraordinary” losses incurred after April 26, 2023 that were “more likely than not” caused by the incident, for up to $5,250 per person, the website shares.
In lieu of the aforementioned cash benefits and credit monitoring services, class members may instead file a claim for a $30 cash payout, the site relays.
The court will decide whether to grant final approval to the terms of the Centerspace class action settlement at a hearing scheduled for December 4, 2024 in Minneapolis. Settlement payouts will be issued “as soon as possible” after the deal is approved and any appeals are resolved, the website notes.
The lawsuit against Centerspace alleged the company failed to prevent the cyberattack, which reportedly involved unauthorized third-party access to files that contained highly sensitive data belonging to current and former employees and current, former and prospective tenants.
According to the data breach lawsuit, the incident compromised the names, driver’s license numbers and Social Security numbers of 8,190 individuals.
