Court Preliminarily Approves $21M Arthur J. Gallagher Settlement, Resolving Data Breach Lawsuits

Arthur J. Gallagher & Co. and Gallagher Bassett Services face a class action over a data breach that reportedly occurred between June and September 2020.
Arthur J. Gallagher & Co. (AJG) and Gallagher Bassett Services, Inc. (GB) have agreed to pay $21 million to resolve several consolidated class action lawsuits that alleged the companies failed to prevent a 2020 data breach that compromised the personal information of more than three million people.

The deal with Gallagher was granted preliminary approval by the court on September 26, 2024. According to the 10-page approval order issued by United States District Judge Mary M. Rowland, the deal covers 3,492,654 individuals who were mailed a letter from AJG or GB that stated that their information may have been impacted as a result of the data security incident, which reportedly occurred between June 2020 and September 2020.
The plaintiffs notified the court of the agreement with Gallagher, and filed a motion detailing the terms of the deal, on September 12, 2024. The parties now await a final approval hearing for the Gallagher data breach settlement on February 6, 2025 in Chicago.

Per the agreement, eligible class members may submit a claim for reimbursement of documented monetary losses that are “fairly traceable” to the data breach, capped at $6,000 per person.
Moreover, the deal will provide class members with the option to claim either three years of identity theft protection and credit monitoring services or, alternatively, a pro-rated cash payment, the document says.
The settlement agreement notes that in addition to the aforementioned benefits, class members who resided in California at any time since June 3, 2020 can file a claim for an extra $100 payment.
Notice of the Gallagher settlement will be sent out by mail within 46 days of the deal’s preliminary approval, the document relays. Class members will have 90 days, beginning on the date of mailing, to submit their claim forms, which can be filed through the official settlement website.
