Country Time Lemonade Mix Makes Fewer Quarts Than Advertised, Class Action Alleges

A class action claims Kraft Heinz has overstated how many quarts of Country Time lemonade and pink lemonade can be made from each 19-ounce canister of powder.

A proposed class action claims that Kraft Heinz Foods Company has overstated how many quarts of Country Time lemonade and pink lemonade can be made from each 19-ounce canister of powder.
According to the 27-page lawsuit, although Country Time drink mixes are represented as able to make eight quarts of lemonade, each canister contains only enough powder to make about six quarts of the drink when the instructions on the label are followed.
“Despite knowing that the 19 oz cannisters of Country Time lemonade and pink lemonade powder drink mixes do not contain enough powder drink mix to make eight quarts, Kraft Heinz has engaged in a widespread marketing campaign to portray that the 19 oz cannisters of Country Time lemonade and pink lemonade powder drink mixes make eight quarts,” the complaint states. “This is not true.”
The lawsuit relays that the Country Time drink mix canisters have a lid that acts as a measuring cup, with one line for measuring powder that makes one quart of lemonade, and another line for measuring two quarts’ worth of powder. Per the case, the label instructions direct users to measure out the powder using the lid and add more or less to taste.
The suit argues that because it is “not feasible” for a consumer to examine and test a product prior to sale, they must rely on the item’s label representations when making purchasing decisions. According to the complaint, consumers reasonably relied “to their detriment” on the Country Time lemonade and pink lemonade label representations since the products could not produce as much lemonade as advertised.
The plaintiff, an Alabama resident, says he has purchased the Country Time drink mixes for his personal use and began to notice that the lemonade tasted diluted. Moreover, the plaintiff claims he was only able to measure out enough powder to make six quarts of lemonade per canister instead of the advertised eight quarts.
The plaintiff says he would not have purchased the Country Time lemonade and pink lemonade drink mixes had he known the canisters did not contain enough powder to make the stated amount of lemonade.
“Plaintiff has had to purchase additional 19 oz cannisters of Country Time lemonade and pink lemonade powder drink mixes to make up for the lost volume of powder to make lemonade and pink lemonade to drink,” the complaint states.
The lawsuit looks to represent anyone in the U.S. who, within the applicable statute of limitations period, purchased a 19-ounce canister of Country Time lemonade or pink lemonade powder drink mix.
