Burcham v. Wallen

Morgan Wallen faces a class action lawsuit after the country music star failed to perform at the Oxford, Miss. stop of his “One Night at a Time” tour.
Morgan Wallen faces a proposed class action filed by a consumer looking to recoup expenses after the country music singer/songwriter failed to perform at the Oxford, Mississippi stop of his “One Night at a Time” tour this month.

The nine-page case relays that Wallen canceled the sold-out April 23, 2023 performance just moments before showtime, ostensibly because he had lost his voice. Although patrons were promised refunds for the event, to date refunds have not been issued through the event’s host, the University of Mississippi, the lawsuit claims.
The suit says that even if concertgoers receive ticket refunds, “no offer has been made to reimburse [them] for other out-of-pocket expenses,” including costs for transportation, lodging, food, merchandise and transaction fees.
According to the Clarion Ledger, nearly 60,000 fans were in attendance at Vaught-Hemingway Stadium at Ole Miss when the following message was displayed on video boards near the stage just before Wallen was set to perform:
“Ladies and gentlemen, unfortunately Morgan has lost his voice and is unable to perform tonight,” the message read. “Therefore, tonight’s show has been canceled. Please make your way safely to the stadium exits. Refunds for tonight’s event will be available at point of purchase beginning tomorrow.”
On social media, Wallen said in a post that he “started losing [his] voice” after a show the night before and found himself “unable to sing” at showtime, promising that all tickets would be refunded at the point of purchase, the case adds.
The Clarion Ledger cited one attorney on Facebook who urged that the “sudden cancellation raises red flags and should be investigated,” and stressed that concertgoers should “not accept a refund that requires a signed release.”
The lawsuit looks to represent all persons in the United States who bought tickets to see Wallen perform at his “One Night at a Time Global Tour” at Vaught-Hemingway Stadium in Oxford, Mississippi on Sunday, April 23, 2023 and who were not provided with a refund or reimbursed for expenses incurred due to the cancellation, including for transportation, lodging, food, merchandise sales and transaction fees.
“Due to Defendant’s cancellation of his performance, Plaintiff, and all putative class members were deprived of the concert performance they paid to see through no fault of their own, and they did not receive the benefit of their bargain with [Wallen],” the case alleges.
