The 18-page lawsuit alleges Crumbl has violated a California privacy law by embedding into CrumblCookies.com web-tracking technology provided by Stripe that secretly intercepts and monitors consumers’ online activity. According to the suit, these “wiretaps” install tracking codes on visitors’ browsers the moment they enter the website and collect information about their online interactions, even as they navigate to other webpages.
Per the case, the web-tracking software integrated into Crumbl’s website allows Stripe to collect and compile customers’ names, email and delivery addresses, geographic locations, IP addresses, payment details and more.
The complaint contends that Stripe, using its database of personal information, can “identify consumers across devices, networks, and identities,” and share the data with its other third-party clients.
The filing says that consumer data is allegedly captured as part of the risk management services Stripe offers to online merchants, such as Crumbl. As the lawsuit tells it, Stripe stores and uses customers’ personal and financial information to evaluate the risk associated with transactions and protect clients from fraud.
However, Crumbl allows Stripe’s tracking cookies to be embedded on consumers’ web browsers without disclosing the data collection practices or providing an opportunity for customers to consent, the suit claims.
Moreover, the tracking codes remain on a consumer’s browser even after the shopper has completed their purchase on CrumblCookies.com, the case shares. Per the complaint, this enables Stripe to capture additional data about the user’s online activity as they make purchases from other clients.
The lawsuit looks to represent anyone in California who made a purchase from CrumblCookies.com.
