Washington’s Convergent Outsourcing, Inc. is the defendant in a proposed class action that alleges the company violated federal law when it sent a collection letter that contained a validation notice and settlement offer, but failed to explain how the plaintiff could fulfill the requirements of both. Specifically, the lawsuit says the defendant’s collection notice could be confusing to the unsophisticated consumer because of the inconsistency created by demanding settlement payment within 30 days, while, at the same time, informing the debtor of his or her right to demand verification of the debt within 30 days. “The unsophisticated consumer would have no idea how to both seek verification of the debt and preserve the settlement offer,” the lawsuit argues.
