Convergent Outsourcing Accused of Misleading Consumers with False Settlement Offer Deadlines

A Texas consumer claims that Convergent Outsourcing offered identical settlement options months apart despite implying that they were time sensitive.
Convergent Outsourcing, Inc. is the defendant in a Texas consumer’s proposed class action that alleges the debt collector offered identical settlement options months apart despite implying that they were time sensitive.
At the center of the lawsuit are two letters received by the plaintiff in April and June 2018 concerning an outstanding balance of $1,318.25 owed to OneMainFinancial. According to the suit, the first letter stated, in part:
“Our client has advised us that they are willing to satisfy your account for 30% of your total balance due to satisfy your past balance. The full reduced balance amount must be received in our office by an agreed upon date. If you are interested in taking advantage of this opportunity, call our office within 60 days of this letter. Your reduced balance amount would be $395.48.”
The letter’s language suggested that paying the reduced balance of $395.48 was a “one-time-only offer,” the case argues. The second notice, however, presented the same settlement option despite being sent nearly two months later, the lawsuit says. By setting forth a false deadline, the suit alleges, the letters misled the plaintiff and put him at a “disadvantage in charting a course of action” regarding his debt.
“Upon information and belief, sending the same generic, repeatable offers to all consumers was a tactic to lure unsophisticated consumers, like Plaintiff, to believe they were getting a one-time offer that they must imminently take advantage of, or lose the opportunity to settle,” the complaint reads.
