Alleged violations of the Fair Credit Reporting Act (FCRA) are at the center of a lawsuit filed in California against The Control Group Media Company, Instant Checkmate, and TruthFinders. The seven plaintiffs who filed the 59-page complaint allege they’re among consumers nationwide who have been the subject of “prejudicial, misleading, and inaccurate” background reports published and/or sold without notice by the defendants. According to the suit, the defendants’ misconduct was discovered through multiple audits conducted by a startup expungement service that found the companies routinely “continued to publish and report expunged and sealed records” even after receiving legal notice to remove such.
“As for the merits of the case,” the proposed class action reads, “[the plaintiffs] have caught [the defendants] red-handed here; what remains to be resolved is simply the number of people harmed and the remedies available to them.”
