Samsung Electronics America, Inc., its parent company, and four retailers are the defendants in another lawsuit that claims they failed to provide an adequate solution for consumers who bought recalled washing machines. According to the complaint, Samsung issued a recall of 34 washing machine models, warning consumers that the “washing machine top can unexpectedly detach from the washing machine chassis during use, posing a risk of injury from impact.”
The plaintiff claims that the three options Samsung offers to consumers who bought the recalled machines do not sufficiently compensate for their losses or fix the problem. According to the complaint, Samsung has provided a retrofit that can be installed to reinforce the washing machine lids, but it does not allow all the settings on the machine to be used as intended. The second option, the plaintiff argues, is a rebate that only covers a fraction of the cost to purchase a new washing machine. The third option—a full refund—allegedly only applies to consumers who purchased the washing machine up to 30 days before the recall announcement, which does not include the plaintiff. As a result of Samsung’s negligence, consumers are left with “a dangerous product that is unusable for its intended purpose,” the complaint says. Despite multiple lawsuits, the defendants allegedly continue to sell the recalled washing machines without warning consumers of its hazards.
