Kass Shuler, P.A. and one of the firm’s attorneys are facing claims that the parties sent two consumers a debt collection letter that misstated the amount of debt they purportedly owed. According to the complaint, the defendants’ December 2017 notice specified the plaintiffs’ balance as $1,946.85 when the last bill they received from their creditor placed the debt amount at $2,001.23.
“Should Plaintiffs have paid the amount of the debt listed in the Demand Letter, Plaintiffs would still be indebted to the creditor,” the complaint points out.
The suit argues that the defendants were obligated under federal law to clearly state the plaintiff’s “amount of debt” and failed to adhere to this requirement.
