Consumers ‘Paying for Air’ According to Lawsuit Against Pret A Manger

Pret A Manger (USA) Limited is facing a proposed class action lawsuit alleging some of its sandwich products are deceptively packaged to hide excessive empty space that tricks consumers into thinking they’re buying more than the package actually contains.
Pret A Manger (USA) Limited is facing a proposed class action lawsuit alleging some of its sandwich products are deceptively packaged to hide excessive empty space – what the suit refers to as "slack-fill" – that tricks consumers into thinking they’re buying more than the package actually contains. The plaintiff – a New York woman – says she purchased the defendant’s Chakalaka Wrap only to discover the two halves of the sandwich had an inch of air between them hidden by an opaque “cardboard shroud” (pictured below). The complaint notes several other Pret A Manger products that allegedly contain between one to 2.5 inches of slack-fill, which the case says results in consumers essentially “paying for air.”
Even further, the suit claims the defendant sells other products that do not contain slack-fill, thus proving the sandwiches in question could have been packaged differently. “There is no reason why the Products could not be packaged in this non-misleading way,” the complaint insists.
The case specifically mentions the following Pret A Manger products:
- Chakala Wrap
- Greek Falafel Wrap
- Green Goddess and Turkey Wrap
- Avocado Pine Nut Wrap
- Bang Bang Chicken Wrap
- Mustard, Chicken and Swiss Wrap
- Any other Pret A Manger sandwich wrap that is packaged with concealed empty space in between the two halves
