Stern v. United Collection Bureau, Inc.
Filed: October 3, 2018 ◆§ 1:18cv5550
United Collection Bureau is the defendant in a lawsuit that alleges the company offered a consumer settlement options with “illusory and arbitrary” deadlines.
New York
United Collection Bureau, Inc. is the defendant in a proposed class action that alleges the company offered a New York consumer settlement options with “illusory and arbitrary” deadlines in order to “pressure” her into making a payment.
The plaintiff claims she received two letters from the defendant in October and December 2017, respectively. According to the suit, the defendant offered the plaintiff the option to settle her debt for $2,217.02 in October and extended another offer in December for $2,108.87.
The case argues that each settlement option, which indicated a specific expiration date, “made it appear that such an offer is a ‘one-time, take-it-or-leave-it offer,’ when in fact the debt holder is prepared to make other offers after the expiration date,” as evidenced by the defendant’s “superior settlement option” in the December letter.
The plaintiff claims the defendant misled her by falsely implying that she would have no choice but to pay her debt in full after each settlement offer expired.
