A New York woman has filed suit against Solomon & Solomon P.C., claiming the debt collector failed to clearly disclose the amount of her alleged debt.
A New York woman has filed suit against Solomon & Solomon P.C., claiming the debt collector failed to clearly disclose the amount of her alleged debt in a collection letter. The letter supposedly contained an “amount due,” but neglected to mention whether the balance would increase due to interest or late fees. The plaintiff says the account was, in fact, accruing interest, but that the collection letter did not specify the interest rate or the day on which the balance was calculated. According to the complaint, “[t]he Defendant, by failing to state that it would add interest to the amount of the debt or by failing to clearly waive interest, made materially false statements.” The suit argues that Solomon & Solomon’s failure to disclose the required debt information resulted in the plaintiff’s inability completely pay off the alleged debt.
