Encore Capital Group, Inc. and two of its subsidiaries, along with Weltman, Weinberg & Reis Co., L.P.A., are listed as defendants in a proposed class action lawsuit filed by a Michigan woman. She claims in her suit that the debt collectors illegally filed a lawsuit against her regarding a time-barred debt, causing her to suffer financial losses. According to the complaint, the debt had been in default for over nine years, and the plaintiff had settled the account in December 2011. Nevertheless, the defendants sued her in an attempt to collect on the debt in violation of the Fair Debt Collection Practices Act, the suit claims. The judge allegedly dismissed the case without prejudice, causing the plaintiff to suffer financial damages.
