A consumer claims Navient and ACS Education Services subsidiary Conduent continually called her cell phone over her student loan debt without consent.

Navient Solutions, LLC and Xerox Education Services LLC (which operates as ACS Education Services and through its Conduent subsidiary) are the defendants in a proposed class action in which the plaintiff claims the companies violated the Telephone Consumer Protection Act (TCPA) in their attempts to collect on a student loan.
Filed in Florida, the complaint alleges the defendants unlawfully contacted the plaintiff by phone regarding her student loan accounts despite the woman never providing the companies with prior express consent to be contacted in this manner. In fact, the case continues, the plaintiff formally revoked any prior consent for Navient to contact her cell phone—either via calling or by text message—back in October 2014. The plaintiff claims Navient, despite the apparent absence of consent, called her cell phone in January and March 2015; in October and November 2016; and later in January and October 2017.
Per defendant Conduent (ACS), the plaintiff claims she first revoked any prior consent for Conduent to contact her via cell phone or through any other form of communication in January 2017. The lawsuit alleges all calls placed by Conduent to the plaintiff’s cell phone were made without consent.
