Aldous & Associates, PLLC is the defendant in a proposed class action lawsuit that claims it violated the Fair Debt Collection Practices Act by falsely implying that an attorney was involved in the collection of a consumer’s alleged debt. According to the complaint, the plaintiff received a collection letter from the firm that contained a statement informing him that his account had not yet been reviewed by an attorney. The suit argues that the letter could be interpreted to mean an attorney may be involved with the collection of the debt and that there is potential for legal action against the plaintiff. In reality, the defendant is not licensed to practice law in New Jersey, and the false implication that legal action may be taken against the plaintiff is an “abusive debt collection practice,” according to the complaint.
