Enhanced Recovery Company, LLC is facing a proposed class action lawsuit that claims it failed to identify itself as a debt collector in communications with consumers.
Enhanced Recovery Company, LLC is facing a proposed class action lawsuit that claims it failed to identify itself as a debt collector in communications with consumers and neglected to inform them that it was attempting to collect a debt. The plaintiff alleges that he received phone messages from an Enhanced Recovery representative, but that he could not determine the identity of the caller from the language in the messages. According to the complaint, Enhanced Recovery failed to comply with the requirement of the Fair Debt Collection Practices Act that requires debt collector to clearly identify themselves and their intentions in their communications. The suit argues that the defendant’s lack of disclosure was meant to entice consumers into returning its calls and providing personal information.
