Lakkard v. Central Collection Corporation
Filed: August 3, 2017 ◆§ 2:17-cv-01070
Central Collection Corporation is on the receiving end of a proposed class action lawsuit claiming it failed to properly communicate in collection letters the amount of consumers’ alleged debts.
Wisconsin
Central Collection Corporation is on the receiving end of a proposed class action lawsuit claiming it failed to properly communicate in collection letters the amount of consumers’ alleged debts. The plaintiff, a Wisconsin woman, says she received four debt collection notices from the defendant between September 2016 and March 2017. The letters allegedly included a “Total Due” that increased with each subsequent letter. The plaintiff argues, however, that the defendant never provided any explanation of why the amount was increasing or any way for the plaintiff to calculate how much she actually owed on a given day. The letters, therefore, violated the Fair Debt Collection Practices Act, according to the suit, which requires that debt collectors clearly communicate the amount of consumers’ alleged debts.
