Advanced Call Center Technologies LLC is facing a proposed class action lawsuit that alleges it misrepresented the amount of a consumer’s alleged debt. The plaintiff says she received several letters from the defendant demanding that she pay the “AMOUNT NOW DUE.” The suit argues that this amount represented, in one letter, the “Amount Past Due” from her credit card statement. The complaint alleges, however, that another letter listed an amount that was equal to the “Total Minimum Payment Due” on her credit card statement.
“There is a difference between the ‘Amount Past Due’ and the ‘Total Minimum Payment Due,’” the suit explains. “The ‘Total Minimum Payment Due’ is the sum of the ‘amount past due’ and the minimum payment, which is not itself due until the ‘Payment Due Date.’”
In other words, the complaint continues, the defendant attempted to collect an amount that was not yet due “to increase its profits under false pretenses.”
