Consumer Says NCR 'Wrongfully Withheld' Pension Benefits

A former NCR employee has filed a proposed class action lawsuit alleging that he was unlawfully robbed of his benefits under his NCR pension plan.

The NCR Pension Plan, its Pension and Benefits Committee, NCR, and six individuals have been named as defendants in a proposed class action lawsuit filed by a former NCR employee who claims he was unlawfully robbed of benefits under his pension plan. The plaintiff alleges that he worked for NCR from October 1961 to February 1980 and took an authorized leave of absence from January 1970 to October 1971. According to the suit, NCR specified that an authorized leave of absence would be counted as “credited service” under its pension plan. When the plaintiff attempted to claim his benefits, however, the company informed him that he had not completed at least 10 years of service with NCR and did not qualify to claim benefits, the complaint says.
The suit argues that proposed class members have had their benefits “wrongfully withheld” and that the defendants failed in their duty to supply their employees with documents detailing the limitations and rights under the plan.
